These Terms of Service ("Terms") govern your use of the website, mobile application, and logistics services provided by NOTRE CARGO("we", "our", or "us"). By creating an account or shipping a package with us, you accept these Terms.
1. Eligibility
You must be at least 18 years old and able to enter into binding contracts under Cameroonian law to use our services. If you use the services on behalf of a business, you confirm that you have the authority to bind that business.
2. Account Registration
- You must provide accurate, complete, and up-to-date information when creating your account.
- You are responsible for keeping your password and account secure. Do not share your credentials.
- New mobile-app account requests are subject to approval by our team. We may decline an account at our sole discretion.
- You must notify us promptly of any unauthorized use of your account.
3. Services
NOTRE CARGO provides freight forwarding and last-mile delivery services between China and Cameroon, including but not limited to:
- Consolidation and loading at our Chinese partner facilities.
- Sea freight to the port of Kribi (Cameroon).
- Customs clearance and onward inland transport.
- Storage at one of our offices until pickup or delivery.
- Online tracking, push notifications, and digital payment receipts.
4. Pricing and Payments
- Transport fees are calculated per cubic meter (CBM) or per carton according to current rates communicated when your shipment is declared.
- Storage fees ("gardiennage") may apply after a free period if you do not collect your package on time. The rate is communicated in advance.
- You may pay in cash, by bank transfer, or via mobile money. A receipt is issued for every payment.
- We may grant discounts at the moment of a payment at our discretion (rounding, loyalty, commercial gesture). Discounts are shown on the receipt.
- A package is released or delivered only once it has been fully paid for, including any applicable storage fees.
5. Prohibited Items
You shall not ship through NOTRE CARGO any item that is illegal, dangerous, or otherwise prohibited under Cameroonian or Chinese law, including but not limited to:
- Weapons, ammunition, or explosives.
- Illicit drugs, narcotics, or controlled substances.
- Counterfeit goods or infringing intellectual property.
- Live animals, perishables without prior approval.
- Cash, valuables, or negotiable instruments.
- Hazardous materials (flammable, corrosive, radioactive).
If we discover a prohibited item in your shipment, we may refuse, report to authorities, and you remain liable for any cost or damage caused.
6. Declared Value, Loss, and Damage
- You must declare the contents and value of your shipment accurately. Under-declaration may invalidate any compensation claim and expose you to customs penalties.
- We take reasonable care of your goods during transit and storage, but we are not liable for loss or damage caused by inherent defects, inadequate packaging, force majeure, or undeclared contents.
- Compensation in case of loss attributable to us is capped at the declared value of the shipment, with a maximum determined by applicable maritime law and our insurance terms.
- Any complaint must be filed within 7 days following pickup or delivery, with photographic evidence where applicable.
7. Delivery Times
Estimated transit times shown in the app are indicative only. We do not guarantee a specific arrival or delivery date. Delays caused by customs, weather, port congestion, or other circumstances beyond our control do not entitle you to compensation.
8. Storage and Pickup
- Packages are stored at the agreed NOTRE CARGO office until pickup. You receive a notification when your package becomes available.
- Free storage is limited to a number of days communicated when the package arrives. Beyond that period, daily storage fees apply.
- After 90 days of non-pickup despite reminders, we reserve the right to dispose of the goods to cover outstanding fees, subject to applicable law.
9. Acceptable Use
You agree not to:
- Use the services for any unlawful purpose.
- Attempt to gain unauthorized access to our systems or other users' data.
- Reverse-engineer, copy, or resell our apps or website without permission.
- Submit false information or impersonate another person.
- Send abusive, threatening, or harassing messages through our support channels.
Violation of these rules may result in suspension or termination of your account.
10. Intellectual Property
The NOTRE CARGO brand, logo, website, applications, and content are protected by intellectual property rights and belong to NOTRE CARGO or its licensors. You may not use them without written permission, except as strictly necessary to use our services.
11. Suspension and Termination
You may close your account at any time by contacting us. We may suspend or terminate your account if you violate these Terms, engage in fraud, or fail to pay amounts due. Termination does not relieve you of liabilities incurred before termination.
12. Disclaimer of Warranties
Our services are provided "as is". To the extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the apps or website will be error-free or uninterrupted.
13. Limitation of Liability
To the maximum extent permitted by applicable law, NOTRE CARGO shall not be liable for indirect, incidental, consequential, or punitive damages arising out of your use of our services. Our total aggregate liability is limited to the amount you paid us for the specific shipment giving rise to the claim.
14. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Cameroon. Any dispute shall first be attempted to be resolved amicably. If no amicable resolution is reached within 30 days, the dispute will be submitted to the competent courts of Douala, Cameroon.
15. Changes to These Terms
We may update these Terms occasionally. Material changes will be announced through the app or by email. Continued use of the services after changes take effect constitutes acceptance.
